Host: Bark Place Dogs
Client: The owner of the Dog[s] being boarded.
The Dog[s]: The Client’s Dog[s] being boarded.
Booking Form: The form completed by the client to contract the services of the Host.
1. Creation of the Contract
1.1 The Host will provide a quotation to the Client setting out the details and costs for the boarding of the Client’s Dog[s]. This will be considered an Offer. Following acceptance of this Offer by the Client, the Host will send the Client a Booking Form. Only upon receipt of a completed Booking Form, together with either a deposit, or payment in full, will the Host acknowledge and confirm that the booking can proceed. This will create a Contract, which will expressly include these Terms and Conditions.
1.2 It is the Client’s obligation to make a full, complete and honest disclosure of their Dog[s] characteristics, behaviours and conditions in the Booking Form and return it to the Host.
2. Deposit and Payment
2.1 A deposit is payable by the Client to the Host at the time of Booking and will represent 50% of the cost of Boarding the Client’s Dog[s]. The deposit, once paid, is non-returnable.
2.2 Once the deposit has been paid, the balance will fall due 30 days before the commencement of the Dog[s] boarding stay. Failure to pay the balance will be treated as a cancellation by the Client. For dog boarding bookings made less than 30 days before the commencement of the stay, payment in full will be due at the time of booking.
2.3 The Host will not be liable to the Client for any form of loss, damage, compensation or other claim in the event of the Host having to cancel the booking prior to the Dog[s] stay commencing, save for the return of monies paid by the Client to the Host.
3. Full Disclosure
3.1 Whilst in the care of the Host, the Dog[s] will spend time with other dogs and it is a fundamental term of this agreement that the Dog[s] is socialised accordingly.
3.2 The Client undertakes to make a full, complete and honest disclosure of all matters, facts, characteristics and tendencies that might make the Dog[s] unsuitable for boarding. This is of the utmost importance in safeguarding the health, safety and welfare of the Dog[s], the Host, any other dogs in the care of the Host and third parties. This includes, inter alia, aggression of any kind towards humans and other dogs, uncontrollable behaviour, bad & anti-social behaviour, destructive behaviour, poor behaviour around toys and food, health issues [to include any illnesses which may be transmitted to or cause ill-health in humans or other animals], lack of house training and an inclination to excessively bark or whine. The Client undertakes to inform the Host of any changes in relation to the matters set out in this Clause that might differ between the time when the Client completed the Booking Form and the commencement of the boarding stay.
3.3 Should the Client fail to disclose on the Booking Form a material characteristic or tendency as set out and dealt with in Clause 3.1 above which renders the dog unsuitable for boarding with the Host, this will be considered a fundamental breach of condition between the Client and the Host and will enable the Host to terminate both the Contract and the boarding arrangement immediately.
3.4 In the event of Clause 3.3 being invoked;
3.4.1 The owner of the Dog will be asked to make immediate arrangements for the Dog[s] to be collected that day.
3.4.2 In the absence of being able to contact the owner of the Dog as set out in 3.4.1 above, the Host will approach the Emergency Contact to make immediate arrangements for the Dog[s] to be collected that day [see Clause 4 below].
3.4.3 If neither the Client or the Emergency Contact are available, the Host reserves the right to place the Dog[s] into local, independent kennels, the cost of which the Client undertakes to meet, together with a transfer fee of £25.00.
3.4.4 No monies paid by the Client to the Host will be returned on termination of the Contract under the provisions set out within this Clause.
3.5 In addition to Clause 3.2 above, the Host will specifically not tolerate any aggression on the part of the Dog[s], and should any form of aggression or aggressive behaviour be displayed, the Contract will be terminated immediately with no refund of the boarding fees and the Client will be asked to make arrangements to remove the Dog[s] forthwith, as in Clauses 3.3 and 3.4 above.
3.6 If the Client’s Dog[s] attacks or initiates a fight with another dog and/or person, causing injury to that dog and/or person, the Client will be responsible for any losses incurred as a result, inter alia, payment of veterinary fees, third party veterinary fees and any other financial losses incurred by the Host.
3.7 The Client further undertakes that the Dog[s] is up-to-date with the recommended veterinary vaccinations and that the Dog[s] has also been treated against fleas and worms, which will remain effective for the boarding stay.
3.8 The Host will only accept Dog[s], male or female that over the age of 12 months have been neutered/spayed.
4. Emergency Contact
4.1 It is an express term of the Contract that the Client will provide the details of an “Emergency Contact”. The Emergency Contact will be a third party available in the UK who will be able to make decisions in the absence of the Client, and on the Client’s behalf.
4.2 The Emergency Contact should be a person who can make decisions about the health, welfare and boarding of the Dog[s]; and, if necessary, provide care or make arrangements for the provision of care in circumstances such as those more particularly set out in Clauses 3.3, 3.4 and 3.5 above.
5. Dog[s] Personal Effects
5.1 The Client will be required to provide the food [and treats if appropriate] needed by the Dog[s] for the duration of the boarding stay and a lead, together with a collar and/or harness.
5.2 The Client will also be required to provide any medication that the Dog[s] might require during the duration of the boarding stay.
5.3 The Client is invited to provide a bed, blanket, toy or the like for the Dog[s] if they think it will provide a necessary level of familiarity or comfort. In the absence of doing so, the Host will provide toys and a comfortable, clean bed for the Dog[s] to sleep in, in a safe and warm environment.
5.4 The Client is asked to make an express preference if they do not wish for the Dog[s] to be given treats during the duration of the stay.
6. Services Provided by the Host
6.1 The Host will care for the Dog[s] for the period of the boarding stay. Care will include, but is not limited to the following: maintaining the Dog[s] mental and physical well-being, feeding the Dog[s], exercising the Dog[s] with walks, stimulating the Dog[s] with play and providing the Dog[s] with water, bedding and toileting, together with a comfortable place to sleep. The Host will be caring, kind, understanding, compassionate and attentive to the Dog[s] needs and will exercise professionalism and due diligence at all times.
6.2 The price paid by the Client for the boarding of the Dog[s] is exclusive of the cost of any goods or services that the Host may be required to provide or purchase for the Dog[s] during the boarding stay. This includes, inter alia, food or additional food, veterinary bills, medication or any item that the Client deems the Dog[s] requires during its stay.
6.3 Should the Client be unable to collect the Dog[s] on the agreed collection date, the Host will continue to care for the Dog[s] as per Clause 6.1 above and the Client will be charged at the rate of £30.00 per day, per Dog for each additional day that the Dog[s] is cared for.
6.4 In the event that the Dog[s] should need Veterinary attention, the Host will timeously make the necessary arrangements and the Client will bear the cost. The Client expressly undertakes to authorise the Host to make decisions about the health and welfare of the Dog[s], particularly in relation to accidents and emergency situations both generally and specifically if the Host is unable to contact the Client.
7. Damage to Property
Should the Dog[s] cause damage to the Host’s home, property or belongings, the Client agrees to pay the cost of repair or reinstatement.
8. Cancellation and Early Collection
8.1 The Client may cancel the Contract at any time. Cancellations must be made in writing and will only be valid once acknowledged as being received by the Host. Non-payment of boarding fees by the Client to the Host will also be construed as cancellation.
8.2 In the event of cancellation on the part of the Client, the following charges will apply:
8.2.1 Cancellation 14 days or more before the boarding stay ~ no charge, but deposit retained.
8.2.2 Cancellation 13 days or less before the boarding stay ~ 100% of total cost will be charged.
8.3 In the event of early collection by the collection of the Dog[s], no sum will be returned by the Host.

10. Photographs
The Host will take photographs of the Dog[s] during the duration of the boarding stay. These photographs may be used in advertising or social media unless the Client expresses a preference for this not to happen.

3.4 In the event of Clause 3.3 being invoked;
3.4.1 The owner of the Dog will be asked to make immediate arrangements for the Dog[s] to be collected that day.
